CLAUSE 1: Applicable and binding general terms and conditions of sale ---------------------------------------------------------------------------------------------------------------- Any order placed by the customer, as well as any deliveries made by SPRL KFW OPTIC implies the purchaser's full acceptance and without reserve of these general terms and conditions of sale, to the exclusion of all other documents, such as prospectuses and catalogues issued by the seller, which are of indicative value only. The cancellation or inapplicability of one of the clauses of the general or special terms and conditions shall not lead to the cancellation of the other general or special clauses which remain completely valid and applicable. Any exemption from these general terms and conditions shall be of value only if it is formally accepted in advance by the SPRL KFW OPTIC. Formal exemption from one of the general or special terms and conditions shall not imply that application of the other general or special clauses has been waived. Article 2: Information --------------------------- The customer moreover declares that he has been fully informed of the characteristics and conditions for the use of the services and products ordered. Furthermore, he certifies: That he is at least 18 years of age. That the contact lenses have been prescribed by an ophthalmologist less than one year previously. That he has been informed of the methods for the use, care and handling of the contact lenses and the care products. That there is no counter-indication prohibiting him from wearing contact lenses. That he undertakes to abide by the strict hygiene rules and the instructions for use provided with the products delivered. By using the Website, that he agrees to the conditions on privacy. Not to use the site for any illegal purpose whatsoever and to accept to use it in accordance with the applicable legislation. Not to pass himself off as another person or entity nor to use a false name or any name that he is not authorised to use. CLAUSE 3: Placing an order -------------------------------------- The information provided by the purchaser, when placing an order by which he makes a commitment: in the case where an error has been made in the wording of the recipient's details, the seller shall not be held responsible in the event that it is unable to deliver the product. Orders are only final when they have been confirmed by the purchaser's payment of the price thereof. Any modification or cancellation by the purchaser cannot be taken into account and the price paid shall not be refunded. The product offers are valid within the limit of available stocks. CLAUSE 4: Delivery ------------------------- Orders are processed from Monday to Friday, excluding public holidays. The parcels are despatched within 1 to 6 working days after receipt of the order, subject to available stocks. If you pay by bank transfer, the time limit for despatch shall only start from the day of receipt of your payment and not from the date of the order. You may choose to have the parcel delivered by the postal service or by any other means which you may select on the site. The delivery times for the postal service are 3 to 10 working days. Other times may be envisaged and depend on the carrier selected. In all cases, we recommend that you give us an address for delivery where you are sure of being able to take delivery of the parcel. A detailed bill corresponding to your order, made out in your name, shall accompany your order. Participation in the postage charges (packaging and forwarding) is added to the total of the order. It is calculated according to weight when the products are added to the basket. We cannot accept any responsibility for postage delays. No damages shall be incurred in the case of the delivery periods being exceeded. SPRL KFW OPTIC declines any liability for late delivery, failure to deliver in the case of force majeure or any event outside its control, which would make it totally or partially impossible to fulfil the agreement or would make it more expensive, or in the case of an act by a third party, such as suppliers of the parties to These Presents, sub-contractors, agents and representatives, or again should the customer fail to abide by his commitments. Article 5: Payment terms ------------------------------------- The purchaser can pay his bill on line by credit card or bank transfer. - By credit card: KFW OPTIC accepts the following cards: VISA and EUROCARD/MASTERCARD. Prior to processing the order, the validity of the purchaser's credit card shall be checked by NEOS, the KFW OPTIC's service provider, and the amount of the order shall be reserved. You never give your card number to KFW OPTIC. SPRL KFW OPTIC uses the NEOS technology, which is the secure payment system on Internet. Furthermore, this system guarantees that your personal payment details remain confidential, and secure, by means of a protocol which automatically checks the validity of the rights of access at the time of payment by card and encrypts all the exchanges to ensure confidentiality. Sensitive information such as the credit card number is only passed between the purchaser and NEOS. Hence, at no time does KFW OPTIC know the purchaser's credit card number. The payment site is protected by various firewalls and protocol conversions to prevent undesirable visitors having access to the data or to payment processors. Consequently, in the on-line sale process, KFW OPTIC is only subject to a best-endeavours obligation; it cannot be held liable for any harm resulting from the use of the Internet network such as, in particular, loss of data, intrusion, virus, breakdown in service, or other involuntary problems. CLAUSE 5 A: Returns – Methods ----------------------------------------- Any return of products must be covered by a formal agreement by the seller and the purchaser. Any taking back by the seller, in the case of a visible defect or non-compliance of the products delivered, which shall be recorded by the seller, shall enable the purchaser to obtain a replacement free of charge or a credit note, to the exclusion of any other compensation or damages. A copy of the bill should accompany your return, as well as a letter giving the reason for this return. We shall then exchange the product or refund it within 10 working days following its receipt. The cost of the return shall also be refunded in the case of an error by us. SPRL KFW OPTIC is obliged to refuse articles that are damaged or already used. CLAUSE 6: Prices ------------------- The prices given by KFW OPTIC are in euro and include VAT. The bills are drawn up in euro, subject to Belgian Value Added Tax (VAT) which is 21%. Participation in postage costs (packaging and forwarding) is added to the total of the order as mentioned in clause 4 of the company's general terms and conditions of sale. The products shall be supplied at the price in force at the time the order is placed. The price shall be paid immediately on placing the order. CLAUSE 7: Dispute ------------------------- Complaints or disputes shall always receive our favourable attention, the good faith of the person who took the trouble to explain his situation is presumed. In the case of a dispute, the customer shall contact the company as a priority so that an amicable solution can be found. Failing this, the Belgian courts (BRUSSELS district) shall alone have jurisdiction. Article 8: Privacy ---------------------- SPRL KFW OPTIC undertakes to abide by a policy of total confidentiality in your regard. Consideration for your privacy is a priority concern for KSW OPTIC. Our aim is to guarantee the highest level of confidentiality and security. You may have to provide KFW OPTIC with personal information for your registration to the boutique.
